Plan Year 2026 consists of the following new Consumer Consent Requirements:
- Certified agents are required to obtain consumer consent prior to supporting consumers, collecting Personally Identifiable Information, and before making changes to a consumer application.
- Please keep a few key things in mind as you prepare to obtain and document consumer consent:
- Certified agents are required to document consumer consent, but may document consumer consent in the format of their choice, but all agents MUST use the Georgia Access Consumer Consent Language.
- Written and verbal consent is allowed as long as the required fields are captured. When documenting consent verbally, consent must be captured by the agent in an audio recording.
- Certified agents may use the Georgia Access Consumer Consent Form to collect consumer consent. The Georgia Access Consumer Consent Forms are available on the Georgia Access agent webpage and in the LMS.
