Due to the Marketplace Integrity and Affordability Final Rule, Deferred Action for Childhood Arrivals (DACA) recipients are no longer considered lawfully present for Georgia Access coverage. Georgia Access will end coverage for any DACA recipients enrolled in Plan Year 2025 coverage and send a letter telling them they’re no longer eligible for coverage.
The term “lawfully present” is used to describe immigrants who have:
- “Qualified non-citizen” immigration status without a waiting period
- Humanitarian statuses or circumstances (including Temporary Protected Status, Special Juvenile Status, asylum applicants, Convention Against Torture, victims of trafficking)
- Valid non-immigrant visas
- Legal status conferred by other laws (temporary resident status, LIFE Act, Family Unity individuals) See a full list of immigration statuses eligible for Coverage through Georgia Access.
