Policies sold on Georgia Access will not exclude services based on gender identity and will not contain a categorical exclusion of coverage for all health services related to gender transition. Policies available on Georgia Access will also affirmatively provide that medically necessary covered services will be available to a policyholder regardless of their gender identity.
Insurance companies may not engage in unlawful sex discrimination in either their policy terms or in operation. If you believe an insurance company’s policy is written in an unlawfully discriminatory way, you may file a complaint with the Office of Commissioner of Insurance and Safety Fire (OCI) . Once you’re enrolled in a plan, if you believe your insurance company has unlawfully discriminated against you in its coverage decisions or claims handling, you have the right to appeal the decision and have it reviewed by the OCI.
